SOUTH LOS ANGELES (January 11, 2014) – Pedestrian Ena Villalobos was fatally struck by a tour bus on Saturday while attempting to cross the street. The accident happened at the intersection of Slauson Avenue and Figueroa Street Saturday morning at around 8:30 a.m. The tour bus was southbound on Figueroa, attempting to turn left onto Slauson Avenue when it struck Villalobos. According to witnesses, Villalobos was in the crosswalk at the time she was struck. The bus, owned and operated by Arana Tour Line, struck Ena Villalobos, as she was on her way to a nearby clinic.
Ena Villalobos was pronounced dead from her injuries. She was 56 years old.
The driver of the tour bus remained at the scene to cooperate with investigators. According to witnesses, Villalobos had the right of way. However, some police officers report the bus had right of way. Wrongful Death lawyer Edmond El Dabe states “It certainly is suspect that police officers who did not witness the accident claim the bus driver had right of way while witnesses claim Ena had right of way. I would investigate further and seek to keep the police officer’s conclusion about what happened out of court.”
If the bus driver is liable for the death, the family of Ena Villalobos can file a wrongful death claim. The husband and children of Ena Villalobos have a claim for wrongful death against the bus driver, the tour bus company, and the insurance company. Wrongful Death damages for the family will include the loss of Ena’s love, companionship, comfort, care, assistance, protection, affection, society, moral support AND the loss of her training and guidance.
In California, pedestrians have right of way. Many drivers turning left will look for oncoming traffic but not pedestrians. The driver of the tour bus that struck Ena Villalobos is liable for disregarding a pedestrian already crossing the roadway. Edmond El Dabe further stated “I don’t care who had right of way, a bus driver should be looking out for pedestrians in crosswalks.”
