WESTMINSTER, CA (September 18, 2013) – Another fatal accident in Westminster this morning. Joey Nungaray, 28 years old, of Fountain Valley has died after a serious automobile accident in Westminster at the busy intersection of Brookhurst and McFadden.
Police say Joey Nungaray was the driver of a car that was struck by a pickup truck, whose driver may have have been under the influence, shortly after 1am on Tuesday morning
Police report that the collision caused such great damage to Joey Nungaray’s car, that he was trapped in the car for about 20 minutes until emergency personnel could pull him out. Paramedics transported him to UCI Medical Center where he died from his injuries at 1:47am.
The driver of the pickup truck was taken to the hospital but the condition of that person is not known. Police have identified him at Emmanuel Garibay. He was driving a white Nissan Frontier truck And was traveling southbound on Brookhurst Street when he hit the Nungaray’s Civic going westbound on McFadden Avenue.
Joey Nungaray is an American hero by virtue of his service in the the US Marine Corps. A Fountain Valley native, he is survived by two daughters. Under California law, the next of kin of Joey Nungaray have a valid wrongful death claim against the driver of the other vehicle and the insurance companies involved. The claim is for loss of love, comfort, companionship, support and society. They also have a claim for loss of financial support.
