SAN DIEGO (July 15, 2013) - Erlinda Lipa Ortin, a 66 year old woman, has died. Erlinda Lipa Ortin was killed by a driver of a Toyota Camry while she was walking across the street at the 10900 block of Clairemont Mesa Boulevard in an unmarked crosswalk. The Toyota was traveling eastbound on Clairemont Mesa when it struck Ms. Ortin.
Attorney Edmond El Dabe states “Many drivers fail to realize that unmarked crosswalks are actually legal crosswalks where pedestrians may cross and drivers must stop. Many pedestrians are tragically killed because drivers don’t know all the rules of the road. The result is another wrongful death.” The collision occurred at about 7:40 a.m. so lack of visibility is unlikely to be factor.
It is not clear whether the driver of the Toyota was under the influence of drugs or alcohol and San Diego Police are investigating. Erlinda Lipa Ortin is survived by her family. Under California law, the family now has a wrongful death claim for the loss Erlinda Ortin.
