RANCHO CUCAMONGA (December 4, 2013) – Pedestrian Ashlyn Gardner was fatally struck by a pick up truck on Wednesday afternoon. Gardner and her seven year old brother were in the crosswalk on East Avenue at Banyan Street when they were struck by a 2000 Ford F350 pick-up truck. They were on their way home from Etiwanda Colony Elementary School at the time. The siblings were rushed to San Antonio Community Hospital in Upland where Ashlyn was later pronounced dead from her injuries. She was 9 years old. Her brother, Landon, had non-life threatening injuries.
The driver of the pick-up truck was identified as a 69 year old male. He told police he did not see the children in the crosswalk. Pedestrians in a crosswalk have the right of way at all times. The family of Ashlyn Gardner may be able to pursue a wrongful death lawsuit against the driver and his insurance. An investigation is under way.
